September 2011, Nm 10/2008-12 und Nm 11/2008-12, entschieden:
Spruch
Der Berufung wird Folge gegeben.
Die angefochtene Entscheidung wird dahin abgeändert, dass die Marken Nr 231 567 und 230 709 gelöscht werden.
Die Antragsgegnerin ist schuldig, der Antragstellerin die mit 7.129,10 EUR bestimmten Kosten des Verfahrens erster Instanz (darin 1.130 EUR Barauslagen) sowie die mit 3.739,75 EUR bestimmten Kosten des Berufungsverfahrens (darin 1.360 EUR Barauslagen), je binnen 14 Tagen zu ersetzen.

Die Antragstellerin ist Inhaberin der internationalen Marke Nr 919 633 "XAVAX", die mit Priorität vom 13. Juli 2005 für folgende Waren in Österreich eingetragen wurde:

Die Antragsgegnerin ist Inhaberin der mit Priorität vom 7. Dezember 2005 registrierten Marke Nr 230 709 "NAVAX" sowie der mit Priorität vom 22. Februar 2006 registrierten Wortbildmarke Nr 231 567:
Beide Marken sind für folgende Waren und Dienstleistungen registriert:
KI 09:
Computer-Software und Computer-Hardware, einschließlich individueller EDV-Lösungen;
KI 35:
Beratung bei der Organisation und Führung von Unternehmen; Dateienverwaltung mittels Computer;
KI 37:
Installation und Wartung von Hardware;
KI 38:
Bereitstellung des nachrichtentechnischen Zugangs zum Internet;
KI 41:
Ausbildung und Fortbildung auf dem Gebiet der EDV;
KI 42:
Technische Planung und Beratung (ausgenommen Unternehmensberatung) auf dem Gebiet der EDV und der digitalen Medien; Entwicklung, Installation und Betreuung von Software, insbesondere auf dem Gebiet der digitalen Medien.
Die Antragstellerin beantragte die Löschung der genannten Marken der Antragsgegnerin. Die angefochtenen Marken "NAVAX" seien für dieselben oder weitestgehend ähnlichen Waren der Kl 9 sowie für einander ähnliche Dienstleistungen der Kl 35, 37, 38, 41 und 42 wie die prioritätsältere Marke "XAVAX" registriert. Auf Grund der evidenten Ähnlichkeit der Marken sowie der Waren- bzw Dienstleistungsgleichheit der Klassen, für die die Marken registriert seien, bestünde für die beteiligten Verkehrskreise eine Verwechslungsgefahr, welche nur durch die Löschung der prioritätsjüngeren Marken gebannt werden könne.
Die Antragsgegnerin wendete ein, die Marken "XAVAX" und "NAVAX" seien ausreichend differenziert. Obwohl die gleiche Buchstabenanzahl und ein ähnliches Sprachmuster vorlägen, unterscheide sich die zischende Betonung des Anfangsbuchstabens "X" im Gegensatz zum eher gedämpften "N" in "NAVAX" deutlich. Darüber hinaus läge die Betonung auf der ersten Wortsilbe, so dass die Unterscheidung der beiden Marken noch stärker hervortrete. Auch stelle die Wortsilbe "NAV" eine gedankliche Verbindung zu Begriffen wie "Navigation", "navigieren", "Navigator" etc her, was bei der Marke "XAVAX" jedenfalls nicht gegeben sei. Da darüber hinaus die Dienstleistungen der Antragsgegnerin nur von einem interessierten Fachpublikum in Anspruch genommen werden, das sich vorweg ausreichende Informationen beschaffe, könne eine Verwechslungsgefahr ausgeschlossen werden.
Die Nichtigkeitsabteilung des Österreichischen Patentamts wies die Löschungsanträge ab. Sie stellte fest, dass die Waren und Dienstleistungen, für die die hier zu vergleichenden Marken eingetragen seien, hochgradig ähnlich oder ident seien. Beide Worte, "XAVAX" und "NAVAX", seien reine Phantasiebegriffe, so dass ein Unterschied auf Grund der Bedeutung nicht festgestellt werden könne. Hinsichtlich der klanglichen Markenähnlichkeit der beiden Worte "XAVAX" bzw "NAVAX" wäre der Gesamteindruck entscheidend, übereinstimmende Zeichenbestandteile dürften nicht in einer zergliedernden Betrachtung isoliert beurteilt werden. Trotz gleicher Silbenanzahl und Identität der Endung stünden beim klanglichen Vergleich der Marken die Anfangsbuchstaben im Vordergrund: das "X" führe zu einem scharfen und markanten Klangbild der Marke der Antragstellerin, das gegenüber dem weich ausgesprochenen "N" eine geänderte klangliche Wiedergabe bewirke. Dazu komme, dass im Deutschen Wörter selten mit "X" begännen, während "N" durchaus als Anfangsbuchstabe geläufig sei. Die streitverfangenen Marken seien auch bildlich nicht ähnlich. Das "X" bzw "N" am Anfang und das Palindrom bei "XAVAX" präge das Erscheinungsbild dieser Marken. Darüber hinaus führe das Erscheinungsbild der angefochtenen Wortbildmarke noch weiter aus dem Ähnlichkeitsbereich heraus.
Gegen diese Entscheidung wendet sich die Berufung der Antragstellerin, mit der sie weiter die Löschung der gegnerischen Marken begehrt.
Die Antragsgegnerin beantragt, der Berufung nicht Folge zu geben.
Rechtliche Beurteilung
Die Berufung ist berechtigt.
Unbestritten ist die Priorität der Marke der Antragstellerin, ebenso wie die Ähnlichkeit bzw Identität der Waren und Dienstleistungen in den Klassen, für die die streitverfangenen Marken eingetragen sind.
Die Marken unterscheiden sich einzig durch die Anfangsbuchstaben "X" und "N". Die Wörter "NAVAX" bzw "XAVAX" sind als zweisilbige Worte vom (in der deutschen Sprache hell klingenden) Selbstlaut "A" geprägt. Es gibt keinerlei Anzeichen dafür, dass in der Betonung dieser Fantasiebezeichnungen ein besonderer Schwerpunkt auf den Anfangsbuchstaben gelegt wird. Vielmehr liegt das erinnerliche - aber nicht betonte - Klangbild, bedingt durch den hellen und längeren Selbstlaut "A" als letzten Buchstaben der ersten Silbe sowie als mittleren Buchstaben in der zweiten Silbe in Verbindung mit dem kurzen, aber zischenden "X" in der zweiten Silbe der Worte ("VAX"). Damit kommt jedoch den Anfangsbuchstaben nicht die Bedeutung zu, die die Antragsgegnerin ihnen gerne beimessen würde. Zwar unterscheiden sich die Anfangsbuchstaben in ihrer Aussprache, im gesamten Eindruck der Wortmarke jedoch verschwimmt ihr anfängliches Klangbild und wird vom - im Deutschen ungewöhnlichen „VAX“ - zweiten Wortbestandteil überlagert. Eine Verwechslung der Worte "XAVAX" und "NAVAX" ist daher nicht auszuschließen. Die streitverfangenen Marken sind daher ähnlich.
Dies entspricht auch dem üblichen Beurteilungsmaßstab der österreichischen und europäischen Judikatur in vergleichbaren Fällen, wie vom Antragsteller beispielshaft vorgebracht (OPM 11. Oktober 1978 = PBl 1979, 149 – Saxit/Maxit; 4 Ob 317/76 = ÖBl 1976, 164 – Palmers/Falmers; EuGH 8. Februar 2012 C-191/11-Norma/Yorma´s).
Da somit allein schon aus dem Klangbild der Marken die Verwechslungsfähigkeit - auch für ein fachlich informiertes und interessiertes Publikum - folgt, war auf das sonstige Erscheinungsbild der Marken nicht weiter einzugehen. Selbst wenn von der Antragsgegnerin dem Fachpublikum ein "N" für ein "X" vorgemacht wird, ist die Unterscheidungskraft jedenfalls nicht ausreichend, um die beteiligten Verkehrskreise vor einem Markenirrtum zu schützen. Damit war aber auch nicht weiter zu prüfen, ob das in Kleinbuchstaben gehaltene Schriftbild der Wortbildmarke "NAVAX" zu einem anderen Ergebnis führen kann, genau so wenig wie die Ausführungen der Antragsgegnerin hinsichtlich der gedanklichen Verbindungen zu "NAVIGATOR", "navigieren", "Navigation" oder dergleichen.
Da zwischen den Marken "NAVAX" und "XAVAX" Verwechslungsgefahr besteht, sind die prioritätsjüngeren Marken - in Stattgebung der berechtigten Berufung - zu löschen.
